Warranty
- The warranty (the “Warranty”) is offered by the Company to the original purchaser (the “Purchaser”) of the Product and is only valid in the Territory.
- The term of the Warranty is for one (1) year from the latter of (A) the date of purchase and (B) the date of delivery to the Purchaser UNLESS noted otherwise on the respective sales invoice or receipt.
- The Warranty is not transferable, negotiable or assignable to any third party except in the case of a one-time gift of the Product by the Purchaser at the time of the Purchase and delivery of the Product. For the avoidance of doubt, the Warranty is only applicable to the original retail purchase and does not cover any subsequent re-sale or subsequent transfer of the Product to any third person, whether natural or otherwise.
- The Warranty is not a guarantee or promise relating to the nature of the material, workmanship or performance of the Product.
- The Warranty shall cover mechanical, electrical and upholstery defects only. The Warranty shall neither over nor include any of the following:
– Products not purchased from the Company or in the Territory;
– Products that are not documented by a sales invoice or similar official receipt as proof of purchase from the Company;
– Use of the Product not in compliance or conformance with the operation manual relating thereto (emphasis added);
– Any negligent or reckless use or care of the Product by any person;
– Any non-operating items such as, but not limited to, paint, coloring, accessories, detachable plugs/attachments and/or product finishes;
– Upholstery and/or fabric defects do not apply to standard wear and tear issues and including but not limited to stains from any liquids, gels or transferable items, marks from frequent usage, poor storage conditions and/or scratches/ abrasions from external bodies/items. A technical evaluation is required to ascertain the nature of any upholstery or fabric defects, and, if determined thereafter to be the result of manufacturer defect(s), solely at the discretion of the Company, affected parts will be replaced at no cost for one time only during the period of the Warranty (provided, that the Purchaser understands there is an average ordering lead time of 12 to 18 weeks and that colors/material might differ slightly from the original Product’s upholstery and/or fabric);
– Consumable items used in or with the Product such as (but not limited to) batteries, filters and gel pads;
– Unauthorized modifications made to the product, altered serial numbers or repairs performed by non-authorized persons, including but not limited to the Purchaser and his agents;
– External faults such as electrical or power failures, wiring and electrical connection issues or defects from using the wrong electrical voltage, watts;
– Accidental or intentional physical damage including from poor storage conditions;
– Damage as a result of natural disasters, civil unrest, fire, theft, spilled liquids, water damage, corrosion, environmental elements, animal or insect infestation or any other force majeure event;
– Damage caused by transportation and handling, including scratches, dents, chips and/or other damage to the finish of the Product, unless such damage resulted from defects in materials or workmanship and is reported to the Company within one (1) week of delivery;
– Shipping, freight, delivery and/or custom/government charges;
– Any non-personal or household use including commercial use (including multiuser organizations), public rental, use for profit or communal use such as in multi-family housing;
– Diagnosis where no defect has been found or noted;
– Under no circumstances shall coverage extend to any loss or injury to a person or loss or damage to property or any incidental, contingent, special or consequential damages or any direct or indirect loss including but not limited to any injury caused by use of the Product to treat any medical or health conditions. - The Company has the sole option to repair or to replace a product with like kind, quality and specifications in the event of product malfunction or issue. If the product is replaced, the Warranty will be automatically terminated. The Product with the original Warranty will then become the sole property of the Company (if replacement is accepted by the customer) without need for further authorization.
- The total value of all repairs and/or replacements made during the term of this Warranty shall not exceed the purchase price paid for the Product.
- The above Warranty is in lieu of all other warranties, express or implied, including any warranties of merchantability or fitness for a particular purpose, whether oral or in writing, and 1Lvest Inc. hereby disclaims any and all other covenants and warranties.
